“The observation of the communications and the operational activity carried out by the acting unit has allowed us to conclude that these intermediaries would be José Luis Ábalos and Jacobo Pombo“says the judge Ismael Moreno in a car from last February 7, to which he has had access Europa Pressin which he authorized a series of telephone interventions on those investigated.
At the moment, neither Ábalos nor Pombo are listed as being investigated in the procedure being followed in the National Court against seven people, one of them Koldo, for alleged crimes of criminal organization, money laundering, bribery and influence peddling.
When pointing out Ábalos, the instructor places the emphasis on a meeting that took place on January 10 in a restaurant in Madrid. “Koldo, among other people, meets with José Luis Ábalos in a reserved area of the La Chalana seafood restaurant between approximately 9:15 p.m. and 10:20 p.m., as reflected in the police report,” he says.
For the head of the Central Court of Instruction Number 2, this meeting “has a special interest for the facts investigated” given the telephone conversation held the previous day between the businessman Juan Carlos Cuetoalleged ‘mastermind’ of the plot, and Koldo.
According to the investigation, in said call “Cueto asked him to say something to a third party before he went on a trip to Peru on January 11.”
The claim of the Balearic Islands
“In fact, Koldo informed Cueto that one of the things to discuss with one of the people who will meet the next day – when he meets with Ábalos – was that, it is understood that he was referring to the procedures carried out with the Balearic Administration to resolve the claim of 2.6 million euros made to Management Solutions,” adds the judge.
Within the framework of the resolution, the instructor of the National Court highlights the intercepted conversations of November 29 and 30, 2023 in which “it is inferred that Koldo had had access to the allegations made by Management Solutions to the administrative file initiated by the Balearic Administration of which they would have transferred to third parties for them to review.”
“Numerous telephone conversations have been observed through which a change of approach can be seen in Soluciones, in the event that the Balearic administration were to remain administratively silent regarding its appeal raised within the claim made,” he adds. .
Next, the judge highlights a series of previous calls that took place in December. According to what he details in his car, on day 2 “Cueto managed to contact Koldo, who informed him that they had just called him and that he had arranged to meet Miguel Tellado and ‘Alberto’ the next day. In that conversation, Koldo stated that he had commented on this matter to the ‘former ministry where I worked before’, having obtained in response that this matter has no legal implications.”
This same Thursday, PP deputy Miguel Tellado has publicly denied having met with those investigated in the so-called ‘Koldo case’.
Added to the call on the 2nd were one from the 7th and another from the 14th of December. In the first conversation Koldo told Cueto that everything was “on the right track.” In the second, he informed him that “the issue of the Balearic Islands file was ‘more than done’,” according to the judge in his order.
Contacts in emails
Likewise, the instructor highlights a call from December 28 in which “it has been observed that Koldo has the ability to put in contact” a person responsible for institutional relations of the Federation of Citizen Services of Workers’ Commissions (FSC-CCOO ) “with ‘Pedro’ through Ábalos, since he would be a personal friend of the latter.”
“In another order of things, but also related to Koldo’s contacts,” the judge refers to his brother’s work life Joseba Garcia. Regarding this point, he points out that “indications have been obtained that once he stops being an employee of EMFESA -an entity dependent on ADIF-, at the express wish of Koldo he will go to work at Correos -a state company dependent on MITMA-.”
“In line with the above, Joseba would be aware of the appointment of the new president of the Post Office -Pedro Saura-, before it became official since he has stated that this person is his friend,” adds the magistrate.
