The Federal Chamber ordered a new process against the Viedma teacher accused of distributing Nazi pamphlets

The Federal Court of Viedma must appoint a new magistrate to carry out the case against Juan Manuel Azcona, after the Federal Chamber of Rock decided “not to accept the material jurisdiction of this court.”

Azcona was arrested in October 2021, in Patagones, and prosecuted in June 2022, without preventive detention, for “Having designed, edited, printed, collected and distributed pamphlets with Nazi phrases and symbols” between April 30 and August 20, 2021 “in different parts of the city of Viedma, province of Río Negro, with a view to the dissemination and promotion of Nazi ideology, based on ideas and theories of racial superiority” according to the resolution signed by surrogate judge Hugo Grecca.

At the time of his arrest, he was a teacher at the Atlantic Zone Regional University Center and an employee in the Management of the Province’s Cadastre Directorate.

The Chamber’s decision was released this week and is signed by Judge Simón Pedro Bracco.

It indicates that the crimes for which Azcona was prosecuted “establish a penalty ranging from one (1) month to three (3) years in prison, It can be observed that it is a crime of a correctional nature, whose material competence does not correspond to this court but to the Federal Court of the city of Viedma».

Adds the resolution that “corresponds, not accept the jurisdiction attributed and return the present proceedings to the Court of origin, so that where appropriate proceed to designate one
magistrate other than the one who carried out the investigation, to develop the correctional trial
respective”.
